Issuing and receiving invoices

KSeF outage: what to do and when to send

When you cannot send an invoice to KSeF, you can still issue it: in offline24 mode at any time, and in emergency mode or during unavailability once the Ministry of Finance (MF) has announced it. You then send the invoice to KSeF by the next working day at the latest, or within 7 working days of the end of an outage, and in a total failure you do not send it at all.

Legal position as at 7 October 2026, under the VAT Act as published in Dz.U. 2026 item 1263. MF's table of 24 February 2026 sets out the same split of modes.

Three situations in one table

Which mode you use depends on who announced what, not on the fact that "something is not working". For Ania, who issues a few invoices a month, this table is enough.

SituationModeWhat the invoice needsDeadline to send to KSeFWho announces
A problem on your side (internet)offline24, art. 106ndaFA(3) structure, P_1 date, QR codes only outside KSeFwithout delay, by the next working day after the day of issuenobody, the mode has no statutory precondition
KSeF unavailableunavailability, art. 106nhas abovenext working day after the day the unavailability endedMF in the BIP (art. 106ne para. 4)
KSeF outageemergency mode, art. 106nfas above7 working days from the end of the outage stated in the end noticeMF in the BIP and interface software (para. 1)
Total failureart. 106ngpaper or electronic invoice, no FA(3) rule, no QR codesyou do not send the invoice to KSeFMF in the mass media when the BIP is impossible (para. 3)

Two caveats. The VAT Act does not define a "working day", and MF has not said whether Saturday is one. An example without that doubt: issue on Tuesday, send by Wednesday. The second concerns the 7-day window: if MF announces another outage during it, the deadline is counted afresh (art. 106nf para. 5), and a total-failure notice switches the window off (para. 7).

Offline24: the mode you choose yourself

Offline24 is the only mode that needs no announcement. You do not have to prove that your internet was down. You can also use it for sales to consumers.

The date of issue is the P_1 date (art. 106nda para. 10), and the buyer's date of receipt is the date KSeF assigns the number (para. 11). The statutory deadline for issuing the invoice, generally the 15th of the following month, does not change. KSeF rejects a P_1 date in the future, while a P_1 date earlier than the day you send is fine.

QR codes are required only when you hand the invoice over outside KSeF, that is to a buyer under art. 106gb para. 4 (art. 106nda paras. 3, 4 and 6). In that case the invoice (or a page next to it) carries two codes: CODE I, labelled OFFLINE, carries the invoice data, and CODE II, labelled CERTYFIKAT, confirms the issuer and requires a KSeF certificate type 2. If the codes do not fit on the visualisation, you may give a separate link or graphic. A buyer with a Polish NIP receives the invoice only in KSeF, so it needs no codes, and in a total failure there are none at all.

Outage, unavailability and total failure

In emergency mode and during unavailability you do the same as in offline24, but the deadlines differ. For Pani Krystyna the difference is this: in unavailability the day after it ends counts, in an outage you have 7 working days from its end.

An offline24 invoice issued just before an outage is announced falls under art. 106nha. If an ordinary outage was announced (art. 106ne para. 1), the art. 106nf deadlines apply. If a total failure was announced (para. 3), you do not send that invoice to KSeF.

Total failure is the exception. Invoices from that period do not go to KSeF, and in the JPK file they are marked BFK. An offline24 or unavailability invoice carries the DI marker in the JPK file only if it has no KSeF number on the day you file. If it already has one, you report it with the number (NrKSeF) and correct an earlier DI to the number. An emergency-mode invoice (art. 106nf) that has no KSeF number on the day you file gets the OFF marker.

How to tell it is an outage

The Act points to the BIP and the interface software (outage), the BIP (unavailability) and the mass media (total failure). MF also runs Latarnia, a public API without authorisation that returns AVAILABLE, MAINTENANCE, FAILURE or TOTAL_FAILURE. We found no MF document that calls Latarnia the Act's "interface software", so treat it as an aid, not as a legal basis.

MF also publishes service notices on its "technical notices" page, for example about disruption in the Aplikacja Podatnika. Art. 106ne does not name that page, and MF has not said whether such a notice counts as announcing an outage within the meaning of the Act. If in doubt, issue in offline24, because that mode needs no announcement.

What if KSeF rejects an offline invoice

The Act does not regulate this; it follows from the KSeF 2.0 Handbook, part II. If file verification fails, the invoice gets no KSeF number and, in MF's words, "has not been issued". You check the error, fix the data and send again. You cannot edit or delete an invoice in KSeF, and an error on an accepted invoice is fixed with a corrective invoice (how to issue one). KSeF does not check arithmetic, so check the sums before sending.

MF has not explained what follows if the rejection reaches you after the art. 106nda para. 2 deadline. Do not send at the last minute: send as soon as the system is back, so you keep time for a fix.

What the buyer gets in the meantime

In offline24 and during unavailability a buyer with a Polish NIP receives the invoice only in KSeF (art. 106nda para. 3). For unavailability this comes from the MF table, because art. 106nh para. 4 does not refer to para. 3. Draft UD477 is what adds that reference. Before the system accepts it, you may give them a voluntary "transaction confirmation" with two QR codes. It is not an invoice. In emergency mode every buyer receives the invoice in the agreed way (art. 106nf para. 2), with the codes as in offline24 if it does not go through KSeF (para. 3).

A consumer, a foreign buyer or a buyer without a NIP (art. 106gb para. 4) receives the invoice in the agreed way, with the OFFLINE and CERTYFIKAT codes. Once the KSeF number is assigned, one code with that number is enough.

If a buyer with a Polish NIP gets an offline24 invoice outside KSeF before it is sent to KSeF, the Handbook gives them the right to deduct from the day of actual receipt. MF nonetheless calls this "incorrect conduct" by the seller and recommends receiving invoices in KSeF (Handbook part II, point 1.8, pp. 31-32). That label applies only to this situation.

From 2027 the KSeF number is to appear in the transfer title between active VAT payers (the art. 108g duty concerns active VAT payers, Handbook point 4.1.5). The duty does not apply to art. 106nda and 106nh invoices that were not entered into KSeF because of an outage notice (art. 108g para. 4).

Prepare before anything breaks

You need a KSeF certificate type 2 before the first outage. You can generate it in advance, it is valid for up to two years, and under art. 106nda para. 7 you download it from KSeF. We described the authentication options in certificates vs tokens in KSeF.

The second question is your software. According to MF, in the Aplikacja Podatnika KSeF 2.0 you issue only online invoices, so offline mode needs software that supports it. Ask the provider whether it generates the QR codes, tracks the deadlines and sends the invoices itself once the system is back. A list of steps is in the KSeF preparation checklist.

Penalties for being late and their status

Art. 106ni para. 1 point 3 provides a penalty for not sending an offline24, emergency or unavailability invoice on time: up to 100% of the VAT on the invoice, or up to 18.7% of the gross amount due where there is no VAT. These provisions take effect on 1 January 2027. On 16 September 2026 MF announced a deferral of penalties to 31 December 2027. Draft UD477 moves art. 106ni paras. 1-3 and 5-7 to 1 January 2028 (art. 2 point 2 of the draft), but that needs an amendment to the Act, and the draft is only at the stage of inter-ministerial arrangements and public consultation (both opened 23.09.2026) and is not law. Para. 4 is already in force: being late under art. 106nda para. 2, 106nf para. 4 or 106nh para. 2 does not lead to fiscal criminal or fiscal offence proceedings. A fuller discussion needs its own article.
